Pulse Park Disclaimer and Waiver of Liability

By booking or participating in activities at Pulse Park Multi-Sport Facility, you agree to this concise Disclaimer and Waiver of Liability. This applies to all visitors, members, and guests across all facility areas (sports courts, gyms, locker rooms, common areas, parking lots). You must be 18 or have a parent/guardian’s consent if under 18.

1. Assumption of Risk

You understand that sports and activities at Pulse Park involve risks of injury, illness, property damage, or death due to physical exertion, equipment use, facility conditions, or others’ actions. You confirm that you are physically fit, have no limiting medical conditions, and will stop and report any issues immediately.

2. Waiver and Release

You release Pulse Park, its owners, staff, and affiliates (“Pulse Park Parties”) from all claims, damages, or liabilities arising from your participation, use of facilities/equipment, or presence on the premises, whether due to negligence or otherwise, to the fullest extent permitted by law. This includes incidents caused by third parties or loss/theft of personal property.

3. Indemnification

You agree to indemnify Pulse Park Parties for any claims, costs, or damages (including legal fees) caused by my actions, negligence, or failure to follow Pulse Park’s rules.

4. Rules Compliance

You will follow all Pulse Park rules, including those on conduct, banned substances, alcohol, tobacco, equipment use, and safety. Non-compliance may result in removal, suspension, or a ban without refund.

5. Medical and Emergency

You authorise Pulse Park staff to arrange emergency medical treatment at your expense if needed. You will disclose relevant medical conditions to staff beforehand.

6. Photography

You consent to Pulse Park using photos/videos of yourself or your minor child for promotional or operational purposes without compensation. You may opt out of promotional use in writing.

7. Booking Terms

Bookings are non-refundable unless specified in Pulse Park’s cancellation policy. No-shows do not qualify for refunds or rescheduling unless approved.

8. Governing Law

This waiver is governed by the laws of the Republic of Malawi. Disputes will be resolved in Lilongwe courts. If any provision is unenforceable, others remain in effect.

Acceptance

By booking, entering, or participating at Pulse Park, you confirm that you have read, understood, and agree to this waiver. For minors, a parent/guardian must agree.
